Re: Redskins Trademark cancelled
"This ruling — which of course we will appeal — simply addresses the team’s federal trademark registrations, and the team will continue to own and be able to protect its marks without the registrations. The registrations will remain effective while the case is on appeal.
So the team still owns the trademarks until the appeal is over. If they get denied, I take it the use of the term Redskins is a free for all and the team will no longer have sole rights to its ownership. edit: Matty's article linked above explained some of my questions. |
Re: Redskins Trademark cancelled
Who decides what is "Disparaging". As a Redskins fan the name "Cowboys" is highly disparaging to me. Quick, some one take a poll and send it in to the tradmark office. I want Jerry Jones to lose his trademark as well. While we are at it with this political correctness witchhunt, tell Obama that his beloved Chicago Bears name is also disparaging. Bears are scary! I want that trademark denied.

lol this is the first thing I thought of this morning they really need to address this problem at the lowest possible level. Meaning im pretty sure if the cowboys didnt kill the indians we wouldnt be having this conversation...and Dallas isnt apart of the collective bargining agreement on sharing proceeds so it wouldnt even effect teh league to get rid of the cowboys |

Hopefully we go to warriors when we do change. It sucks but it'd going to happen folks.

FYI -
For those that keep posting why Braves, Chiefs and other Native team names are not offensive, the issue is the word SKIN. A reference to someone's SKIN COLOR. REDSKINS. Get it? I do not care what our team name is. I was born and raised in the Washington DC area so I am a huge fan of the team. I would be a fan regardless of the name. The name means nothing to me. If this is SO upsetting to you, you need to get a life. |

meanwhile, no real evidence was submitted, so it's hard to see them losing this. |

Yeah I have to agree. So tired of hearing this crap day in and day out. I would just change the name to "Skins". Get rid of the face on the helmet and all should be good. Plus we can all keep our 30 years worth of gear in our closets. But I would exhaust every ounce of NFL leverage I have first. I'd tell the league - I'll change the name but first I want this, this, this, and that. Or we can fight this in court for the next 5 years. Your call. |

They are going after every name that involves Indians. They stopped targeting the other names because it was hurting their cause with redskins, but they claim all sports names with Indian mascots are derogatory to Indians. According to Susan Blackhorse, they needed one name to fall, then the rest would go like dominoes. Also, if its about skin color, then the state of Oklahoma needs to change its name. As Oklahoma translates out to "Red People" or "People with red skin". |
When the case first arose more than 20 years ago, a federal judge in the District of Columbia ruled on appeal in favor of the Washington Redskins and their trademark registrations. Why? As the district court’s ruling made clear in 2003, the evidence ‘is insufficient to conclude that during the relevant time periods the trademark at issue disparaged Native Americans...’ The court continued, ‘The Court concludes that the [Board’s] finding that the marks at issue ‘may disparage’ Native Americans is unsupported by substantial evidence, is logically flawed, and fails to apply the correct legal standard to its own findings of fact.’ Those aren’t my words. That was the court’s conclusion. We are confident that when a district court review’s today’s split decision, it will reach a similar conclusion. In today’s ruling, the Board’s Marc Bergsman agreed, concluding in his dissenting opinion: It is astounding that the petitioners did not submit any evidence regarding the Native American population during the relevant time frame, nor did they introduce any evidence or argument as to what comprises a substantial composite of that population thereby leaving it to the majority to make petitioner’s case have some semblance of meaning. The evidence in the current claim is virtually identical to the evidence a federal judge decided was insufficient more than ten years ago. We expect the same ultimate outcome here.”
|
Re: Redskins Trademark cancelled
When I first heard about it I thought, "Now, Redskins fans will be able to get cheaper Redskins merchandise as anyone could make stuff that says 'Washington Redskins' without paying the licensing fee. Can the Giants lose their protection?" Then realized this will have a negative impact on NFL revenues and the league will make them change the name.
Yes, I know they keep their protection while it is appealed. |

For those that keep posting why Braves, Chiefs and other Native team names are not offensive, the issue is the word SKIN. A reference to someone's SKIN COLOR. REDSKINS. Get it?
FYI - Many Native Americans are offended by the Kansas City Chiefs, because the title of Chief is such a great honor to be given, that they consider that word sacred. So for Kansas City to use that title in their name is nearly blasphemy in the eyes of Native Americans. Secondly, if you actually read your history, you'd realize that the reference was first used by the Indians themselves to distinguish themselves apart from the settlers. Which is where we also get the term "pale face" as that described the white settlers. It was also used to describe their "home made" bug repellant that they would apply to their skin. This stuff would would turn their skin red. (I believe I heard that from a Native American.)
I do not care what our team name is. And if one loves the nickname because the name is what got them interested in Native American culture and history, then they need to get a life? Wow...seems a bit narrow-minded to me. |

i just hope the DS, while defending the redskins name, is also alternatively creating a plan b for when he is forced to change the name.
the change is inevitable. a smart person would be thinking of a way to spin this into a positive as much as possible. the "over his dead body" letter, seemingly faux PR driven native american charity and directing fans to tweet/harass senator reid were not examples of being forward thinking, smart or positive. |

The name isn't racist. Since when does revisionist history, and a social media "feel good" movement, trump millions of screaming fans rooting FOR the Redskins and past court decisions on the matter?
This is the group attacking us. This is most of the people calling all Redskins fans racist: F'em. |

I have dreads... but luckily, I'm not white? No one's ever complained. Hah.
Anyway, change the name to Warriors and be done with this. We'll probably get booed at every game now. I'm surprised they haven't started marketing anti-redskins products. |

I'm surprised they haven't started marketing anti-redskins products.
Personally, I don't think they should ever have to change the name, but imo there really are only two possibilities that make any sense: 1) like you said- make a change that can't be challenged and move on. or 2)Commission an unassailable polling company to conduct an extensive Native American only poll, and have proof one way or another. And the poll shouldn't be about where the name ranks in problems, it should be very cut and dry. Are you ever offended by the use of the term Redskins. not does the NFL team using the term Redskins offend you, or do sports team names that use Native American imagery offend you, or any other variety of poll splicing techniques. Just a cut and dry is it an offensive term period. I also believe that the legalistic word play answer just isn't going to make the situation any better in the long run, and with public media tending towards the change the name crowd, the Redskins position is only going to get weaker over time. |
