Banks, stores, bars have commercial insurance policies but usually are not liable for damages caused by 3rd parties, especially criminal acts by 3rd parties ... unless you can show (1) the bank owner knew or should have known that a robbery was foreseeable (2) bc of a pattern and practice of robberies on their property, and (3) owner had time but failed to avail themselves to remedies like more security, better lighting, cameras etc and (4) a reasonable owner would have done something.

Standard practice to try and find the biggest pocket possible. Most of us private citizens are judgment proof, you could get a 1M judgment against me but would have to wait for me to win the lottery to collect.

You have to try and attach liability to one of the commercial parties and you (1) build up the "pattern and practice of robberies" narrative; then (2) sue the bank, property owner, security company, city, state, county, police department ...

A bank, property owner usually have an indemnification agreement so they are repped by the same firm. Here they will probably sue over 20 named defendants but only deal with maybe 2 defense attorneys.

Typically the law does not like making someone responsible for the actions of a third party, especially criminal acts, and this proving of a pattern and practice of violent crime rising to the level the bank or property owner are liable is very high and hard.

But, I imagine there is some type of crime near any given block of an urban city to try and argue "pattern and practice" but good luck, its hard.

I didnt let him, he gave me the finger, and was all road ragey i gave him the "step outside" motion ... then he didnt look our way.

this guy was an old guy. i would have whipped his ass and im no tough guy or pretend tough guy. if he had stepped out, i would have put him in the hospital

I dont think this is a R v D issue. I read a lot of right wing comment sections and most agree with and want penalties for people being stupid with a gun.

Enhanced penalties for guns in the commission of a crime has always been an agreeable issue. id say far left would be more against it bc of the disproportionate effect on POC and incentivicing (i cant pell that word right now) for police to do even more cracked window policing of low income areas.

DC police did this top Gun thing back in the 90s where officers got incentives for bringing guns off the street. I was 3rd chair for a case against an officer in DC federal court (civil rights/excessive force not re top gun but top gun was a part of it), the officer would just pull over every black male he saw, search their car and if he found a gun arrested them and get the incentives. If they didnt have a gun hed let them go.

Clear violations of a persons 4th but when youre a 24 black male in DC and a cop detains you searches you and lets yo go ... who do you complain to? Wasnt like it is now with cellphone cameras and in this climate of where police has lost presumed trustworthiness.


id just like to see an enhanced penalty for traffic road rage related events where a gun is displayed.

I personally think sentence enhancement for weapons should be in play but I do worry about the discretionary use by states attorneys. Discretionary use can lead to discrimatory use ... and that is part of the systemic racism.

DC police did this top Gun thing back in the 90s where officers got incentives for bringing guns off the street. I was 3rd chair for a case against an officer in DC federal court (civil rights/excessive force not re top gun but top gun was a part of it), the officer would just pull over every black male he saw, search their car and if he found a gun arrested them and get the incentives. If they didnt have a gun hed let them go.

Clear violations of a persons 4th but when youre a 24 black male in DC and a cop detains you searches you and lets yo go ... who do you complain to? Wasnt like it is now with cellphone cameras and in this climate of where police has lost presumed trustworthiness.

I am sincere when I say I agree with you and you're right , it shouldn't be a R v D thing but it is and every and all restrictions anyone comes up with will end up just that R v D. Lets say you want higher penalties for RR with a gun I will bet a cup of coffee that the NRA will say you're picking on gun owners and fight it. IMO (and only mine) Any RR incident should mandatory loss of license until a Judge settles the dispute in Court and that should include "anger management " counseling.

I personally think sentence enhancement for weapons should be in play but I do worry about the discretionary use by states attorneys. Discretionary use can lead to discrimatory use ... and that is part of the systemic racism.

I do think we need to incarcerate misdemeanors less, have better programs and assistance .. and get away from private for profit jails.

Putting the right people in jail for longer is the answer. Every day you can read stories of someone that has been arrested 22 previous times that shockingly, yet again commits another crime. We need to stop letting real criminals out of prison before serving the appropriate time.

I'm all for private enterprise over government, when at all possible. But for-profit jails will always be a problem. The people that are involved in illegally using "pipelines" can and should be put in jail with the above mentioned people. Those people must pay the price for their wrongs against others, like any other criminal should. Will not be easy, because the same people that need to be arrested are part of the system involved in arresting people, but it needs to be done.

Learned today that Louissianna, Mississippi, Oklahoma, Georgia, Arkansas, Alabama have the 6 highest incarceration rates anywhere in the world.

States with most murders per capita?

1. Louisiana
2. Alabama
3. Mississippi
4. Missouri

Who knows if theres correlation or causation here ... one thing is clear, southern states like locking people up and have the highest murder rates.

The part that made me smirk about the Uvalde shooting (which I realize there is really nothing to smirk about); is that it happened down in Big Red Texas where everyone carries their guns to protect themselves yet the same fate occurred that happened in Blue Sandy Hook.

The whole argument of self defense falls on deaf ears to me, you can't defend against a sucker punch.
