Lol, VERY MISLEADING article title. Not saying what he did was right in any way, shape, or form but when someone says "indicted on sexual abuse" I start to imagine jail time and registering as a sex offender.

He is facing a maximum 180 DIJ if convicted. On the contrary I was actually unaware a grand jury convened for this type of case, or that it would be tried in superior court.

All right all right. I see whats up. However he still doesn't have register as a sex offender and the maximum is very rarely used. For example Chris Brown could have easily gotten a nice prison sentence (and certainly deserved one) for beating the life out of Rhianna. However he ended up with probation and community service on the other side of the country in his home state, because they wouldn't want to inconvenience him.

So while Haynesworth is eligible for a 180 days in jail I have a hard time believing that playing grab ass and engaging in sexual harassment will get him jail time. More then likely he'll end up with probation, a suspension from the league, and a civil suit. Then again I'm not exactly a legal expert.

I agree DB....what I didn't know was that a misdemeanor charge could carry a penalty exceeding one year. I'm not familiar with the various classifications of misdemeanors.

I wonder if Shanahan will insist on keeping him on the team. I hope the NFL suspends him so they can finally kick him off the team. They should've unloaded him a long time ago.

Im first assumed the government also tried to get him indicted on a 3rd (10 yrs max incaceration) and/or 4th degree (5 yrs max) sexual abuse charges b/c I dont understand why they would go to the GJ to indict him for misdemeanor sex abuse. Both those require either force, threat of force or mental incapacitation (lady was drunk drunk, unconscious, couldnt consent etc).

The only thing I can think is that a GJ indictment makes it harder to try and win on a "lack of sufficient evid to charge" type motion to dismiss before trial.

I co-chaired a 3rd, 4th degree sex abuse and mis. sex abuse (really just simple assault) in DC superior ct last summer. My experience is that the gov't (like alot of st atty offices nowadays) do not offer good pleas for sexual crimes, they are taking a hard stance on those types of actions and seek atleast some jail time which normally means a trial.

From the DC annotated crim code, Ct of Appeals found evid was suff to convict for mis sex abuse when a guy "moved his seat to be near her, repeatedly touched her, and remarked that she should call him for a good time." I think anything that AH might have said to her like "call me for a good time" or "what are you doing after work" or "whats your number lets get together" could hurt him in court b/c it shows his intent to touch was sexual or a physical attraction.

he could still be found guilty of a lesser included non-sexual offensive touching.

Yesterday, Redskins defensive tackle Albert Haynesworth was indicted on sexual abuse charges in connection with an incident which occurred on February 13 at the W Hotel. Haynesworth allegedly caressed a waitress' breast during the incident; the court documents, though, show that the encounter was far more involved than simply a wealthy sports player getting a little too handy with the wait staff.

According to the court documents filed by the U.S. Attorney's Office, Haynesworth pulled out a debit card to pay for his table's $811.23 bill, tapped the waitress on the shoulder with the card, then "proceeded to put the card down the center of [the waitress'] bra," and moved his hand near her breast and asked "can I do that?" After the waitress said no, Haynesworth allegedly moved "his fingers in circles around [the waitress'] left nipple." Upon being interviewed by a security guard at the hotel, Haynesworth said he "didn't touch" the waitress, because she was "a little black girl" and he "doesn't even like little black girls." Haynesworth later told police that the waitress "was just upset I have a white girlfriend" and that the waitress "was trying to get with me."

As Amanda Hess comprehensively points out, those suggesting that the woman's charges are bunk would be well-served to curb their victim-blaming for any number of reasons. Haynesworth's been offered a plea deal which would dismiss the sexual abuse charge if he pleads guilty to one count of simple assault, which might potentially save the player jail time -- the deal's on the table until mid-May.
