A Miami judge on Friday scheduled the trial for the man charged with shooting and killing former Washington Redskins safety Sean Taylor to begin April 16, according to an Associated Press report. Eric Rivera Jr., 21, will be the first of the four suspects accused of killing Taylor to go to trial. The men will be tried separately.
|

How is that it takes 4 years to take these animals to court? What is wrong with the state of Florida?

Two words. Due ... process... |
Re: First trial in Sean Taylor killing to begin April 16
Such a shame. It's still hard to believe sometimes.
|
Re: First trial in Sean Taylor killing to begin April 16
^ indeed.
Edit: when we were playing against NE and Gro was tearing up our defense, I thought to myself, it would not be possible if Sean was still here. I cannot help but think of Sean from time to time. I am amazed by the fact that I never had met Sean and yet he made such impact on me and everybody else. |

4 years = due process? Michael Jackson died June 25th, 2009 and his negligent doctor has been tried, convicted and sentenced. |
Re: First trial in Sean Taylor killing to begin April 16
lol Our judicial system is such a joke.

Amazing isn't it? This happened in Nov. 0f 2007 and these guys are just now going to court? WTF?? |
Re: First trial in Sean Taylor killing to begin April 16
I know the main charge to these alleged criminals and murders is murder which has no statute of limitations. But some of the lesser charges like robbery has a limit. Below is the state of Florida Statute of limitations:
Offense Designation Time Limitation 3rd Degree Felony 3 years 2nd Degree Felony 3 years 1st Degree Felony 4 years Life Felony None Capital Felony None |

Re: First trial in Sean Taylor killing to begin April 16
RIP Sean...seems like just yesterday we were chillin on the patio at the U between classes...

Re: First trial in Sean Taylor killing to begin April 16
I hope they bring the hammer down on them. Every time I saw one of our various free safeties (Atogwe, Moore, Doughty, or Landry back when he played fs) miss a play over the past 4 years, I think of ST.

I wonder if they will press for the death penalty?

You can't get the death penalty unless it was a planned murder. This wasn't a planned murder, Sean wasn't even supposed to be home that night so the death penalty is out of the question. I believe in a life for a life though. These sacks of shit aren't going to be worth a damn to society any longer and we really could use the extra space. |

I was thinking Justice.....System but yours works too. I bet had ST's murderer murdered some Animals in cold blood, he would already be in jail... I'm sorry for the above rant but it sickens me to see this stuff. People taking so dang long to go to trial when it is obvious they are guilty. I hope he gets the death penalty. ST was a great player and he was a young guy with a young family, it all got taken away too fast. |

At the moment, the DA is pressing for a conviction... Juries are unpredictable but here is a judicial certainty:
If this guy on trial is found not guilty, he will not get the death penalty.
First things first... |
4 years = due process?
Michael Jackson died June 25th, 2009 and his negligent doctor has been tried, convicted and sentenced.
Yes that is due process. It is not as if these folks have never been in a court room before this. There have been premilinary proceedings and a judge has overseen all of them and led to this court date. What has happened from the time of apprehension and indictment until today is what is known in the US as "due process". It is rarely swift and not always efficient, but the entire concept of US jurisprudence with regard to criminal matters is built on due process. As of this moment, this defendant is INNOCENT in this matter. The upcoming trial may change that status, but until that trial happens the young man is innocent. |
But due process requires the notion of a "fair and speedy trial." How is this "speedy"?
The defendant here was indicted "speedily" and since then he and his representatives have been in front of the court with pleadings for things like access to proseuction evidence (discovery) and the like. That means the legal process has been done at a sufficient pace to match the concept of a "speedy trial". That would likely not be the case if the defendant had been arrested 4 years ago and put in a dungeon somewhere and on April 16 2012 he would see the light of day and the inside of a court room for the first time. The other adjective you used was "fair". The defendant has to have a fair trial too and probably a "fair" trial is a tad more important than a "speedy" trial. |

If time is needed to ensure fairness, that time should be taken. But, still, the speedy indictment which you mention is not the same as a speedy trial. My understanding is that there have been big gaps of time over the last 4 years when investigation, discovery, etc., were not being actively pursued. Dead time works against the notion of speed. |

We've got to convict all those pot-smokers first. The murderers and rapists will just have to wait. |

Got to keep our priorities in order: Get Martha Stewart Stop the weed smoking so we can get them hooked on prescriptions Worry about a little girl losing her father (because he was generous to a family member at a birthday party and allowe guests) some other time. |

Wonder...if it were Brady instead of ST, would the case have already been tried and convicted? (not wishing anything on Tommy Terrific...at all). |

What the hell?! The trial is postponed, once again. For sixth time... It must be difficult for Sean's family. |

This is bs. Those losers need to just quit f'n around and get it over with.

Yep, if that would have happened over here in TX, they would have that mess wrapped up, three doing life and one in the ground. And that still not good enough for what they deserve. imo

Re: First trial in Sean Taylor killing to begin April 16
But sportscurmugdeon thinks this is perfectly fine. He calls it (wait let me say it in the most condescending tone I can find) due process. I call it delay tactics.
|
Re: First trial in Sean Taylor killing to begin April 16
The judge in this case did not do himself or the judicial process any favors.
When the defendant fired his lawyer recently, the judge warned him that there would be no postponement in the trial. Now, the judge has granted a postponement. Now, since it will be July until the prosecutor can figure out when he might be available in September/October to stage the trial, it is perfectly possible that the date could be pushed even further back in the event that the prosecutor's calendar and the defense attorney's calendar do not mesh. Obviously, the judge is perfectly within his authorities to move the date back for this trial, but given his statement to the defendant and the subsequent postponement, there is no reason to believe that the defendant will not try this tactic again in the future. It didn't cost him anything the last time... |

Of course this one is a delay tactic. And for the moment, the defendant has the upper hand in the delay game. |

I think this is just stalling on the defense' part at this point. |
Re: First trial in Sean Taylor killing to begin April 16
This is whats wrong with our judicial system. Not only are we being taxed to keep these assholes feed, housed, and locked up, but Seans family has had to live with this. Shit, is what this is. If you can't put together an effective defense in 5 years, just plead guilty and be done with it. The sentence should be that he has to live in the DC area for the rest of his life. Eye for an eye.

Re: First trial in Sean Taylor killing to begin April 16
My first post WP.
Sean Taylor forever!!!!!! I would like to see justice for the Taylor/Redskin families but idk how there can be. IMO, no sentences for the ones on trial could repay/replace what the world lost. But the way I see it is, if a Miami hero is killed in Miami and those guilty are sentenced to a Miami prison, well,.... I'll be sure to get the mailing address and send some pink laced panties addressed to those found guilty- No lube. (I apologize for enabling/encouraging forced male orgies(hopefully)). HTTR and all 'Skins families |
