He should win as a matter of law if 2 of the facts from the completely unbiased story out of Boston linked above are true.

1. A 25k fine was the maximum punishment allowed for equipment tampering under the CBA.

If he rolls into federal court and confesses to being the mastermind of the whole thing from beginning to end, and he admits the phone had texts that said "I did it. F Goodell" and flips off the Judge and the Commissioner on the way to the plaintiff's table, he is still entitled to the protections of the CBA.

2. He had no prior notice that he would be, or could be, suspended games for "not cooperating"

The NFL can't make up infractions and punishments that didn't exist at the time of the violation. If he didn't have notice of a possible suspension for not cooperating, or obstructing, or whatever, from the CBA, existing league policy, or from Ted Wells super lawyer the NFL can't make it up as they go along. Pretty basic labor law.

If it can happen to them, it can happen to us.

NM. It already has. We were punished for exceeding the cap in an uncapped year.
