Last I heard about his contract demands, he wanted a good $10M and didn't want to accept less than that because that's what he felt he was worth. If his salary demands dropped to reflect those of a backup QB who hasn't performed particularly well in recent seasons, he might get signed.
Foster counts $1.3M, none of it guaranteed. Kaepernick would cost much more than that.
