rape trials are very very difficult to defend. the pending result of a SAFE (sexual assault forensic evidence) kit will define this case imo. if they are able to race his dna, his only defense is consensual intercourse which turns into a he say, she say.
you could be convicted of rape with little more than a crying sympathetic looking woman up on the stand saying you did it. despite all other evidence not supporting her version, that jury will only remember that crying woman, mother, daughter, sister, granddaughter, etc...
in a rape trial last year, we did a voir dire of the venire pool, more than half of the 150 or so people either were sexually assaulted or had a close one who was and had to be excused. interestingly enough, 28 of the first 32 potential jurors were white women. i personally think the state atty and jury commish were in on it since they were all friends. dont be charged with rape if your a black guy in a rural county in maryland.
with rape, once that word is uttered in a courtroom full of prospective jurors, they have already made their mind up before hearing and considering all the evidence.
i will say big ben, now, is set up to be vulnerable to any woman's accusation of rape or misconduct. after this case, any woman could make a claim if there is a scantila of evidence he will have to plead. something like witensses saying they saw them together or saw them leave together is all the corroboration needed even though the fact that they were together just places him there and not that he did a crime.
