That and the school does not have to put up with the kids who do nothing but cause problems a disturb the class. My daughter went to private High School and the teachers in whole are not better they just don't have the distractions and class sizes are smaller. Public schools could do two things and improve greatly over night.

Screw the teachers union and fire all teachers that perform poorly year after year. Kick the trouble causing kids out of school because they are not going to learn and do nothing but disturb the class. Now those kids that you kick out of school Tell them they can either get a job or go to jail. I know that last part is extreme but we cannot have them just roaming the street and we consider working their schooling.
