damnit, i can't believe this guy. as if the skins offseason hasn't had enough troubles, now this guy is sueing portis. i think portis shouldn't have to pay him because he paid half, then the guy got cut. he could've picked #26 with the cardinals if he wanted to. instead he has to complain that some guy has his old number on a team he isn't a part of anymore.

It didn't say anywhere in their handwritten contract that the deal was contingent on both remaining on the Skins so Portis should just pay up and get it over with. Besides, he probably carries that much around in petty cash.

Mooby - Aren't you constantly saying that players sign a contract and they have to honor it. Why shouldn't Portis honor this deal. Ohalate deserves the money, he sold the jersey number. That's like selling someone a car and once you start riding the train they don't feel they owe you for the car anymore.

well i feel that because he already got 20k just for clinton wearing it in camp, why should portis have to honor the other 20k because he wasn't there. the deal was 20k up front, 10k at week eight, and the other 10k at christmas. ohalete was cut before preseason i believe, so if he had had the number before that and he got cut, then the number would've been free for anyone to take. if it was the case that portis pay 40k up front all in one, and portis only paid 20k, then maybe i would say that portis should just pay the other 20k. because what it looks like to me is that it would be portis' number to keep after he paid all the instillments, instead of it being his number after the down payment. the way the contract looked like, is that clinton doesn't officially own the jersey number until he paid all instillments, but because ohalete got cut it wasn't his number so he couldn't make clinton pay for it.

He's right. The contract never stipulated that if Iffy was cut, Portis wouldn't have to pay him. So by default Portis owes him the money.

It was a simple contract. Give me the number, I give you $40 grand in 3 separate installments. Iffy gave him the number. He has to give Iffy $40 grand, simple as that. All other surrounding circumstances are irrelevant.

And seriously, Portis could blow his nose and come up with enough green to pay him off, I don't even know why he'd want to take it to court.

maybe the two are enemies and really don't like each other. i guess your right about paying the money though, i just wish it would be over.

Sucks for Iffy. Chances are a third of that $18,000 goes to his lawyer, leaving him about $8,000 short of what he contracted for.

We don't really know what Iffy was entitled to since we don't know the precise wording of the contract and whether or not Portis' obligation to Ohalete existed after Iffy was cut. Ohh well, it's done.

No, legal agreements are usually negotiated by two different attorneys. It is a conflict of interest to represent two different parties to a transaction. Moreover, the attorney need not be based out of a state the two parties reside in; the attorney should only be licensed to practice in the state in which the agreement can be enforced. In fact, you don't even need an attorney licensed anywhere to draw up an agreement - individuals with no legal experience do it all the time. I've drawn up a Living Will for a man living in New York State and I'm not even an attorney.

It's painful, but nice to have all of these legal questions arise - it's rare that I get a chance to discuss the law other than with people who know a lot about and can argue with me about my impressions/understanding of the law.
