I don't really get how it's possible. Isn't there/shouldn't there be some sort of law or regulation stipulating a trademark has to be done in good faith/in fairness ? Could easily be bypassed, but those obviously unfair trademarks could be avoided IMO.

The thing that's more puzzling is that the decision also said the Washington Football Team is too generic to be trademarked. So apparently one cant trademark something like "yellow lemon" because it's too generic. What all this tells me is that Washington is going to move away from a generic name like WFT and actively pursue a traditional nickname like Redwolves or Monuments. |
