Not sure about the Federal Rules but, in Maryland, a Judge cannot grant a dispositive motion without a hearing i.e. judge's can't dispose of a case through dismissal or summary judgment without an oral hearing giving each side a chance to make argument.

Alternatively, he could have denied the Motion to Dismiss without a hearing which then would have moved the case into the discovery phase.

Right now it is in limbo - not moving forward, but not dismissed.

Gotcha, I thought he had actually dismissed the request for dismissal, but you are right, he just said he would hear arguments on whether to dismiss the case.
