you cant have sex with a drunk girl. if they are too drunk they cant consent period. id imagine her peeing on herself would be enough evidence that 1) she could not consent and 2) big ben mental state that he knew she was too drunk.

its a really crappy maryland law (as it is applied, not the intent) regarding dimished capacity. under that law, everyone of us could have been guilty of rape in MD.
