There are no laws against flag burning that are enforceable because the Supreme Court ruled flag burning is constitutionally protected.

Supreme Court Strikes Down All Laws Banning Flag Desecration (1989): Outside the 1984 Republican National Convention in Dallas, Gregory Lee Johnson burned a flag in protest against President Ronald Reagan's policies. He was arrested under Texas' flag desecration statute. In its 5-4 ruling in Texas v. Johnson, the Supreme Court struck down flag desecration laws in 48 states by ruling that flag desecration is a constitutionally protected form of free speech.

Congress has made seven attempts to overrule the U.S. Supreme Court by passing a constitutional amendment making an exception to the First Amendment in order to allow the government to ban flag desecration. In 1990, when the amendment was first brought up, it failed to achieve the necessary two-thirds majority in the House. After the Republican congressional takeover of 1994, it has consistently passed the House but failed in the Senate.

As a Marine I swore an Oath to this Nation, it's Republic and the Flag for which it stands.

I could understand this point of view if it was YOUR flag that someone stole from you. But what if it was my flag? On my own property?

That's my bottom line -- the flag burning issue is more about property rights than anything else. If I buy a flag for whatever reason it is my property. And not you nor the government have the right to tell me what I can and cannot do with my flag.

Please note, dmek, that this is my opinion, my personal philosophy. Obviously the government does not adhere to that. But that's what I think, and that's the way I think things should be.

In most jurisdictions, you won't be able to burn your house down due to the threat you pose to other houses around you. Ditto for your car.

That's not the reason for flag burning laws. They don't try to pass those laws because of the risk you pose by setting something on fire. It's a speech issue only. To the politicians, and some misguided citizens, it's simply a way to control morality -- something this country is very fond of doing.
