Re: Ongoing CBA discussions
So as we await Judge Nelson's ruling any lawyers out there want to fill us lay people in on why it might have taken her two + weeks. By this, I mean to ask - what is the usual time for an injunction of this nature, and is she doing additional studies and research, or is it mainly a matter of the backlog in her other court tasks and trials. Is this the only case she is dealing with (I would find that hard to believe). I am sure she wants to make as certain as possible that her decision will stand up through appeals, what amount of that research will she do on her own, how much will be thru the use of court researchers?

Re: Ongoing CBA discussions
So if Judge Nelson rules in favor of the players, doesn't that mean a temporary lift of the lockout, allowing free agency? I mean is not like the league can appeal right away, right? I don't see the downside of having free agency right now and then having the league appeal the decision at a later date.

Re: Ongoing CBA discussions
This Judge Nelson is really pissing me off. She could have made that ruling over a week ago...and now it was supposed to be today and it's already 4:30 and still nothing.

Right now she wants to seem impartial and encourage the two sides to talk and reach a long term resolution to the problem. Thereby taking up less of the courts time and resolving the issue for at least somewhere around 5 years.

Also she encouraged the sides to talk and to talk in minnesotta and then she assigned a judge without clearing his schedule. 3 days of talks and then on hold for a month in part becasue he needs to catch up on his caseload.

On a side note, I wonder how much restraint do teams' front offices must have to show in this situation. I mean if you are a team wanting to deal a player (like the Eagles with Kolb) or a team wanting to look at free agency first before the draft (like just about every team), you would want for this to get resolve before the draft or at least have the opportunity to have free agency temporarily before the draft. I am sure there are a lot of teams that will be up the sh*t creek because of this lockout and the inability to make transactions in free agency.

Re: Ongoing CBA discussions
So I wonder if this opens the door for player for draft pick trades? If the appeals court takes a week or so, what's to prevent teams from acting now using 2010 rules?
