Sometimes I can't figure this judicial system out. Some cases are open and shut right away...others drag on forever with no justice being done. Makes me sick.

I believe you're right about needing premeditation. But if I were a judge (horror), I would say: They did plan to break and enter and trespass, and did so. They did plan to bring a gun, and they murdered a man with said gun (as charged, innocent till actually guilty) that would be enough premeditation for me to seek the death penalty.

I agree, IMO the act of packing the gun to commit an incredibly serious and dangerous crime makes and creates premeditation.
That would be like me packing a gun to confront someone that I might potentially fight with, my expectation if I did this is I might need and use the gun.Why else would I take the gun? Taking the gun is a premeditated act.

To me this is not a death penalty case. I know emotions still run high on this subject but the guys that did this are being punished. They've completly ruined their lives for trying to be gang bangers. Plus who would you give the death penalty to? The shooter? All of the guys that entered the house? Didn't the guy that stayed outside in the car get 25 years? These guys will be old men by the time they get out of jail, I don't want the shooter to ever get out.

I'm sorry for the above rant but it sickens me to see this stuff. People taking so dang long to go to trial when it is obvious they are guilty.

I do not support, have never supported, and will never support the death penalty; no matter if someone murders someone, they do not deserve to die. Life in prison w/o possibility of parole, yes, but not the death penalty.

Read the second post and I'm suprised it's only been 4yrs cause it seems longer. On another note I thought there were 3 suspects and 2 of them already plead guilty for a reduced sentence? I thought only the shooter was fighting the charges and the other two were going to testify against him?
