Civil courts use the "preponderance of evidence" standard, which is "whether a particular fact is more probable than not probable".

Maryland courts define "more probable than not" as "whether a fact is more likely so, than not so" ... or (whether a fact is 51% or more likely to be true, than 49% or less not true".

... of course in civil cases, jurors thinks they have to decide a case beyond a reasonable doubt; and in criminal cases jurors tend to decide cases on their gut and the lesser preponderance of evidence standard.

i subpoena cell phone records a lot and I have never seen the actual text messages. just whether a text message was incoming or outgoing.

ive had clients who can somehow go online and print out their texts (maybe only on certain phones/carriers)

perhaps mcnally and the other guy turned it over voluntarily .. before the Pats had time to see what was on there and scrub clean?

the text seem like the smoking gun to me. written contemporaneously at the time of act = truthful. this wasnt some guy who wanted to burn the pats and started sending out exploratory texts after the fact.

cant believe the Pats let that slip through the cracks.

lesson - all team employees and players must have a business provided and owned phone with the data property of the Pats exclusively.

The Atlanta Falcons were punished draft pick(s) and big fine for piping in crowd noise. The Patriots should get a hefty fine and lose draft picks as well. Brady should get some kind of fine and/or suspension as well. IMO the ball deflation in an AFC Championship game is worse than pipping in crowd noise, because it directly effects the game.
Of course this happened (ball deflation) because Brady requested it. No lowly equipment manager would do this unless a player asked him to do it.

It's a story because Tom Brady and the Patriots denied and lied about all of it, which we now find out wasn't true. I think Goodell even said himself that lying about issues to investigators would bring even a swifter punishment than the actual matter at hand.

The problem is that Tom Brady is protected by the NFL. Mark my words he will face no discipline action or fine of any kind....

It seems to me that other sports are much stricter about things like this than the NFL. I don't hate the Patriots but IMO they deserve a strict punishment. Loss of draft picks is BS. As the most severe punishment - everyone involved that "ordered" the deflating, should be banned from working / coaching in the NFL for life. Brady should be suspended by the NFL for one season.

It depends on how much a scumbag Robert Kraft is - he strikes me as a smart man, but surely he knew that winning had to come at any price. If i am wrong about him then he fires those on staff that orchestrated the deflating...

He should get a game or two for lying. He's a dumb ass for not just coming clean and being honest. But I really don't care. Doesn't make him Aaron Hernandez or Greg Hardy cause he lied about deflating a football for a half of a blowout game.

Comparing off the field transgressions to on the field transgressions is mixing apples and oranges and is just plain stupid.

The NFL cares enough about ball pressure that it has a rule about it. They also care enough about it to have specific procedures in place, such that the balls have to be presented to the head official two hours before the game for testing, and kept under watch until just minutes before the game starts. If the NFL didn't think ball pressure makes a difference in performance they wouldn't make a rule about it and wouldn't go to these lengths to enforce it. Brady's a cheater and should not be considered for the HOF.

i think the balls were deflated for every game for a long time. Who knows how long.

The fact that Brady was pissed after the Jets game in the reg season this year bc McNally wasnt able to deflate the balls, to me, means Brady expected every game to have deflated balls. But since the jets dont trust the pats, i imagine it was a lot harder for McNally to duck into a bathroom.

i just feel bad for Robert Kraft. he looks like a schmuck. if he asked brady about this before Kraft did his "demanding an apology" speech ... brady left him out to dry.

Just doesn't seem to be that big a deal to me. Lowering ball pressure a pound under the limit just isn't important to the outcome of a game. Besides, what should they do about Aaron Rodgers? He admitted that he over inflated them. So he's a cheater too? Also the Colts balls were under inflated too so I guess Luck is cheating as well.

The fumbling part has no merit to it because there's no proof that this made the backs hold on to the ball better.

In football there are all kinds of small things that teams and players do to bend the rules. Atlanta pumped in crowd noise and they still sucked last year. None of this stuff has a impact on whether a team wins or losses a game.
