As a former HR person you are correct. While he is in rehab, the team cannot comment on that. They can say something like "Scott is away from the team right now dealing with personal matters", or something to that effect. One option for Scot would be to go on FMLA, under provisions of the law he can claim health reasons and have up to 12 weeks to go to rehab and what not. Once his 12 weeks are up, if Scot is no better, then the Skins can get rid of him. They would be allowed to comment on it, but they would have to watch what they say to not get sued. A statement like "Scot's rehab was unsuccessful so we had to terminate him" would be lawsuit worthy.

A statement such as "Scot is no longer an employee of this organization due to not being able to adhere to the code and guidelines that we have in place for all employees". No liability there.
