Foley is at fault. I believe I read somewhere that even after he was shot he kept approaching the officer.
It's like a speeder hitting someone that blew a stop sign. The speeder shouldn't have been speeding, but that doesn't excuse the guy that blew the stop sign... he is at fault. I know it's not a parallel analogy but you get the point.
