It shouldn't result in any penalty. For one thing, it happens all the time around the league. Secondly, the rule is more about direct contact with the palyer or an employee of the team (a coach for example). And finally agents and owners/execs get around this like this: The agent does all the talking (that's completely allowed) and the team guy just listens but doesn't make any response until 12:01 am.
