Rape is still rape, but i see so many young men, and young women, whose lives get destroyed because of this age of consent stuff. The law doesnt care that they both wanted to have consensual sex, only that one person was legally an adult and therefore it is a crime.

They have to have some mitigating factor that keeps it fair. You can get a drivers license at 16, but yet sex is still illegal until your 18. My wife is 5 years younger than me, that means i would have been in jail when our relationship began in high school, going by today's laws.

Snake , 16 year olds can have sex ,with other 16 year olds , when an adult starts having sex with a minor , thats when it becomes a crime . As far as an 18 year old having sex with his 17 year old girlfriend , i agree that he should not be charged with a crime , that seems plain stupid . Now as far as you having 5 years on your wife , well you are both adults , however if you were 18 and having sex with a 13 year old ,,,,, thats a crime < not saying you were or even knew her then > , but if an 18 year old even attempted to hook up with either my 13 or 15 year old niece ... he would be safer in police custody then if I walked in on them .
