The Senate of the United States shall be composed of two Senators from each State, chosen by the Legislature thereof, for six Years; and each Senator shall have one Vote. Pre-17th Amendment vacancies were filled by the State Legislature which, in turn, could allow the governor to appoint a temporary Senator until the assembly could hold the election. After the 17th Amendment, there were restrictions placed on temporary appointments and, as a result, some States have to allow the seat to remain vacant until it is slated for general election.
