8th Circuit Rules That Lockout is Legal

Starting a new lockout thread with this news.

Some say this is signficant because it gives the owners more ammo. Others say this ruling was expected and as far as both sides have gotten in negotiations, the owners won't use this as major leverage.

Next few days are going to be huge

Interesting in the ruling is that there is not a dissenting opinion by Judge Bye. Maybe that comes later, but if not then to me that seems like there won't be an En Banque appeal.

I just hope this news doesn't disturb any current progress they have made.
It would suck to start all over on any issues that have been settled.

I don't think this changes too much.
It simply re-affirms that the owners have the legal right to have the lockout (which had essentially been granted since the appeal).


But, as per ESPN there is language in the ruling that:

o it exempts the rookies and FA from the lock out

o it allows the players to re-file the anti-trust case in Sept. at which point the owners would face triple damages if they lose.

Ok so now ....

What does this all mean in regards to Rookies and FA's? I'm confused as to how to take it..... are they saying because those two groups were not technically an employee so they are not bound by the decertification? Lockout? does it mean the owners can start negotiating contracts with them because they were none employees and not apart of the lawsuit?

Help..... lol.

The NFL would not be permitted to appeal any ruling by U.S. District Judge Susan Richard Nelson's court regarding a new injunction for rookies and free agents, according to lawyers who have read the decision. The wording of Friday's decision says that injunction, if sought, would be legal.

Friday's ruling contains language that leaves open what rights "free agents and rookies" could have under the lockout. The NFL's lockout rules prohibit any contact between players and teams regarding virtually all matters and explicitly contract negotiations are deemed illegal. According to the 8th U.S. Circuit Court ruling those issues "should be addressed by the district court in the first instance."

According to the NFLPA source, the potential injunction on rookies and free agents that would be filed with Judge Nelson would be for the right for those players to immediately negotiate and sign deals.
